Definitions

Renter: A User who rents an EV charging point through the Platform.

Charging Point: An electric vehicle (EV) charging station located at a Host's property.

Booking: A Renter’s reservation of a Charging Point.
2.7
Service Fee: A fee charged by HomeCharge for facilitating the Booking.
3.
Eligibility
To use the Platform, you must be atleast 18 years old and capable of entering into a legally binding agreement. By using the Platform, you represent and warrant that you meet these requirements.
4.
Account Registration
4.1
Users must register for an account to use the Platform. You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
4.2
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
5.
Host Obligations
5.1
As a Host, you agree to offer your Charging Point for use by Renters in accordance with these Terms.
5.2
You are responsible for ensuring that your Charging Point is safe, functional, and compliant with all relevant laws and regulations of the respective Governments (Both State & Central).
5.3
You must accurately describe your Charging Point and any associated conditions or restrictions in your listing.
5.4
You may set your own rental rates, subject to any minimum or maximum rates that we may establish.
6.
Renter Obligations
6.1
As a Renter, you agree to use the Charging Point in a safe and responsible manner, in accordance with these Terms.
6.2
You are responsible for any damage caused to the Charging Point or the Host’s property during your use.
6.3
You must adhere to the booking times and any other conditions set by the Host.
7.
Bookings and Payments
7.1
Renters can book Charging Points through the Platform. All bookings are subject to acceptance by the Host.
7.2
Payment for the Booking will be processed through the Platform. We will hold the payment and release it to the Host after the successful completion of the Booking, less any applicable Service Fees.
7.3
The Renter agrees to pay the total amount for the Booking, including any applicable taxes and Service Fees.
8.
Cancellations and Refunds
8.1
Renters may cancel a Booking according to the cancellation policy specified by the Host in the listing.
8.2
Refunds for cancellations will be handled in accordance with the Host’s cancellation policy.
8.3
Hosts may cancel a Booking in the event of unforeseen circumstances. In such cases, Renters will receive as per the refund policy.
9.
Insurance and Liability
9.1
HomeCharge does not provide insurance for Hosts or Renters. You are solely responsible for obtaining any necessary insurance coverage.
9.2
Hosts and Renters acknowledge that the use of a Charging Point involves inherent risks, and you agree to assume those risks.
9.3
To the maximum extent permitted by law, HomeCharge is not liable for any damages, losses, or injuries arising from the use of the Platform, including but not limited to the use of a Charging Point.
10.
Privacy
10.1
We are committed to protecting your privacy. Our Privacy Policy outlines how we collect, use, and share your personal information.
10.2
By using the Platform, you consent to the collection and use of your information in accordance with our Privacy Policy.
11.
Intellectual Property
11.1
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are the exclusive property of HomeCharge or its licensors and are protected by copyright, trademark, and other intellectual property laws.
11.2
You may not reproduce, distribute, modify, or create derivative works of any content on the Platform without our prior written consent.
12.
Prohibited Conduct
12.1
Use the Platform for any illegal or unauthorized purpose.
12.2
Interfere with or disrupt the Platform or servers connected to the Platform.
12.3
Engage in any fraudulent or deceptive practices.
12.4
Post, upload, or transmit any content that is unlawful, defamatory, or infringing on others' rights.
13.
Termination
13.1
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice.
13.2
Upon termination, all provisions of these Terms that should reasonably survive termination will remain in effect, including but not limited to provisions regarding ownership, disclaimers, indemnity, and limitations of liability.

Dispute Resolution
